Chelsea’s liquor license snatched for now

Chelsea’s Café’s this week will close at 10 p.m., and the live music has been cancelled.

Here’s the back story: The state office of Alcohol and Tobacco

Control raided the restaurant in January. After a court hearing (in March, the ATC told owner David Remmetter he needed to change his zoning status within 30 days. Remmetter says he took steps to get rezoning through the Metro Council, but the process usually takes 60 to 90 days (read Councilwoman Tara Wicker’s reaction and about the “Save Chelsea’s” groups that formed as a result.

On April 21 around 4 p.m., ATC agents returned to Chelsea’s this time to yank the restaurant’s liquor license. Remmetter says he tried contacting the ATC, but the office was already closed. The next day—after Remmetter says he left several phone messages with the ATC and couldn’t get any response—Judge Trudy White granted a temporary restraining order so Remmetter could keep his business open. This prompted the ATC to immediately take steps to have the restraining order dissolved.

Chelsea’s must rezone or face shutdown

Chelsea’s Café is being backed into a corner to change its rezoning status. David Remmeter, owner of the popular Perkins Road restaurant and live music venue, pleaded “no contest” to charges of operating a bar without a license to do so and agreed to pay a $2,000 fine. His restaurant license is suspended for one year unless he meets certain conditions from the Louisiana Bureau of Alcohol and Tobacco Control, such as changing the zoning status to reflect operating as a bar. If Remmeter loses his restaurant license, he will be forced to shut down the business.

“The other part of the stipulation is he has a choice to get his city restaurant license to match the one he has from the state, or he can rezone and receive a bar zoning that would allow him to get a license from the state, called the restaurant conditional permit,” says ATC Commissioner Murphy Painter, who explained with that particular zoning, Chelsea’s Café can be a restaurant until 9 p.m. and be a bar until closing time, as long as ratio and qualifications are intact and there’s no zoning issues within the area. “That’s how complicated it is. I’m not a demon. I just do what I have to do.”

Remmeter says he is working to get his rezoning status through the Metro Council. In the meantime, he says, Chelsea’s will continue offering a full menu all day and live music after 10 p.m. Remmeter says that at his old location by LSU, alcohol sales outnumbered food sales. Since he moved to the Perkins Road overpass, food sales have surpassed alcohol sales. Painter, however, argues that the records show Chelsea’s is “selling barely more food,” which still puts the restaurant out of qualifications to be considered a “bona fide restaurant.”

“This is just the tip of the iceberg,” says Remmeter, who adds that a few restaurant owners in town are looking at ways get around the ATC restrictions. “It’s a big deal. We’ve got a strong business; people like this place.”—Rebecca Breeden

Founder: Voodoo Can’t Move Date, Location – New Orleans News Story – WDSU New Orleans

The founder of the Voodoo Experience says a communication error with City Park means that one of the area’s largest outdoor music festivals may not happen this October.

WDSU first broke the story Monday that Voodoo was seeking to move the event to the last weekend of the month to coincide with Halloween, but that prior bookings at the park made that impossible.Festival founder Steve Rehage said Tuesday that he had agreed on the new dates with City Park officials. He said someone even updated the dates on the park’s Web site just before Voodoo officially announced its Halloween plans.”They actually posted the date change on their website on Feb. 16, 10 days before we sent out our press release and changed our Web site,” he said.But City Park leaders say they can’t understand the confusion, because Voodoo has secured the same dates with the park for the past five years.
